Provider

AKK-IT, owner Alexander Kick, Johannes-R.-Becher-Str. 14, 39218 Schönebeck, Germany.
Contact: docsentry@outlook.com

The full provider identification pursuant to § 5 DDG is set out in the separate Legal Notice (Impressum). Your contracting party for using the App is the above provider; the purchase is processed via Google Play (see § 6).

1. Scope

These General Terms and Conditions apply to your use of the DocSentry app (the "App") as a user. A consumer is any natural person who enters into the legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB).

Obtaining and purchasing via Google Play is additionally governed by Google's terms. Mandatory statutory consumer rights and individual agreements (§ 305b BGB) always take precedence over these GTC.

2. Subject matter and description of services

DocSentry is a local, encrypted organisation and management aid for documents (an organisation tool). Content is stored exclusively on your device, encrypted with AES-256-GCM (zero-knowledge, see § 4). The scope of functions includes, in particular, scanning and text recognition (OCR), automatic data extraction and classification, the management of deadlines and appointments, encrypted backups (.dsvault) and optional online features (cloud backup, email import, official checks).

Processing on the device: Text recognition and the AI-assisted analysis run entirely on your device; for these features, no content is transmitted to the provider or third parties.

How OCR and analysis work: Automatic text recognition and data extraction work heuristically and may recognise information incorrectly, incompletely or not at all. The features serve to make your work easier and do not replace your own review of the content.

Not a backup service: The App is not a storage or backup service operated by the provider. Responsibility for creating and keeping backup copies lies with you (see § 4). Optional cloud backups are stored encrypted in your own cloud storage; the provider has no access to them.

Organisation aid — not a replacement for original documents: DocSentry serves solely to organise and manage digital copies of your documents. The App is not an archive and not a retention solution and never replaces your original documents. You are obliged to continue to keep your original documents yourself and independently of the App (see § 4). Any statutory or contractual retention, proof or presentation obligations (e.g. tax- or commercial-law retention duties) are neither fulfilled nor affected by using the App. Copies or scans stored in the App do not necessarily have the same evidentiary value as the originals.

No legal or tax advice: Automatically recognised information and derived hints (e.g. about deadlines, warranty or consumer rights) are purely informational and constitute neither legal nor tax advice and no legal service within the meaning of the German Legal Services Act (RDG).

Minimum requirements: Android 12 (API 31) or newer, at least 3 GB of RAM and 500 MB of free device storage; the optional local AI search requires correspondingly more RAM and storage depending on the model.

3. Conclusion of contract

The free-of-charge usage contract is concluded upon installation or initial setup of the App. The paid contract for the "DocSentry Unlimited" unlock is concluded upon completion of the purchase process via Google Play.

4. User duties and obligations; zero-knowledge; data backup

(1) You undertake not to use the App unlawfully or abusively, and you are yourself responsible for keeping your password, PIN and recovery key confidential. You keep your original documents independently of the App yourself; the App does not replace them (§ 2).

(2) Zero-knowledge note: DocSentry encrypts all content according to the zero-knowledge principle exclusively on your device. The provider at no time has access to your password, PIN, key or content and cannot reset a forgotten password.

Important: If you lose your password/PIN and recovery key, recovering the stored data is technically impossible by design — including for the provider. This is a deliberately chosen security property of the App and not a defect. You are informed of this property separately before setup and expressly confirm your understanding there.

(3) Data-backup obligation: You are obliged to keep your password/PIN and recovery key safely and separately and to regularly create your own backup copies of your data. The provider provides tools for this (encrypted .dsvault backup, key export as a Data Matrix code or .dskey file).

5. Rights of use

The provider grants you a simple, non-exclusive, non-transferable right to use the App on your devices for your own purposes. Any modification, decompilation (except to the extent permitted by law), distribution or commercial sublicensing is prohibited. All rights in the App remain with the provider or the respective rights holders.

6. Prices and payment

The App can be used free of charge in its basic version. The "DocSentry Unlimited" unlock is a one-time purchase at a price of €4.99 (incl. statutory VAT); it is not a subscription. Purchase and payment are processed via Google Play; Google's terms additionally apply in this respect.

7. Updates

For the paid unlock, the provider provides you with the updates that are necessary to maintain the App's conformity — including security updates — for a period of at least 24 months from the purchase (§ 327f BGB). Updates may require the presence of a compatible device and operating-system environment as well as an internet connection. Functional changes going beyond the statutory update obligation are at the provider's discretion.

8. Warranty

Where provided for a charge, the statutory rights in respect of defects for digital products (§§ 327 et seq. BGB) apply, including the update obligation (§ 7). Statutory consumer rights are not restricted by these GTC.

The heuristic operation of OCR and analysis described in § 2 is a functional description; occasional recognition or extraction errors are technically inherent and do not, in themselves, constitute a defect. Statutory rights in respect of defects remain unaffected.

9. Liability

(1) The provider is liable without limitation for damage arising from injury to life, body or health that is based on a breach of duty by the provider, its legal representatives or vicarious agents, as well as for damage based on intent or gross negligence, within the scope of an expressly assumed guarantee and under the Product Liability Act.

(2) For damage arising from the breach of material contractual obligations, the provider is also liable in the case of simple negligence, but limited in amount to the foreseeable damage typical for this type of contract at the time of conclusion of the contract. Material contractual obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely.

(3) In all other respects, liability for simple negligence is excluded.

(4) A change in the burden of proof to your detriment is not associated with the above provisions.

10. Data loss

For the loss of data, the liability provision of § 9 applies accordingly. If a data loss is based on the fact that, contrary to § 4(3), you did not create a backup or lost your password/PIN or your recovery key, contributory negligence on your part (§ 254 BGB) is to be taken into account. The irreversible loss that is inherent by design upon loss of access data and recovery key (§ 4(2)) is not a defect and does not give rise to any liability of the provider. The App merely stores copies for organisational purposes; your original documents remain with you (§ 2, § 4).

11. Device performance, battery and heat generation

The App performs computationally intensive processing (in particular text recognition, encryption and analysis) on your device so that your data does not leave the device. Increased battery consumption and noticeable warming of the device during these operations are intended and contractually agreed and do not constitute a defect. Please do not use the App on an already strongly heated device, not under strong heat exposure, and discontinue use if your device issues a temperature warning. In all other respects, the liability provision of § 9 applies; any contributory negligence (§ 254 BGB) remains unaffected.

12. Right of withdrawal

For paid digital content, you as a consumer are generally entitled to a 14-day right of withdrawal (§§ 312g, 355 BGB). This right of withdrawal may expire early if you have expressly agreed that the provider begins performance before the end of the withdrawal period, and you have confirmed your knowledge that, by giving this consent, you lose your right of withdrawal, and you have received a confirmation of this (§ 356(5) BGB). This consent and confirmation are requested during the Google Play purchase process. Details and a model withdrawal form can be found in the withdrawal instructions (Annex 1).

13. Refunds

Please direct refund requests first via Google Play (usually self-service within 48 hours) or in accordance with Google's refund policy. Your statutory rights in respect of defects (§§ 327 et seq. BGB) and any right of withdrawal remain unaffected. Independently of statutory rights, the provider will, on an informal request, endeavour to grant a goodwill refund via Google Play; there is no claim going beyond this.

14. Availability

No particular or uninterrupted availability of the App is warranted. Functions may be restricted by maintenance, updates, dependency on third-party services (e.g. cloud providers, email providers, official online services) and by device and operating-system compatibility.

15. Term and termination

The "DocSentry Unlimited" unlock is a one-time purchase and grants a permanent right of use; it is not a continuing obligation (subscription). You may end the usage relationship at any time by uninstalling the App. Upon uninstallation or resetting the App, the locally stored data is deleted.

16. Changes to these GTC

The provider may amend these GTC with effect for the future, provided there is a valid reason to do so (e.g. changes in the legal situation or in supreme-court case law, technical or security-related adjustments, new or discontinued features) and the amendment is reasonable for you, taking the provider's interests into account.

The provider will inform you of amendments within a reasonable period before they take effect, in text form or on a durable medium (e.g. as a notice in the App), highlighting the material changes. Material amendments equivalent to concluding a new contract become effective only with your express consent; continued use does not, in this respect, constitute consent.

17. Data protection and legal notice

Information on the processing of personal data can be found in the separate Privacy Policy. The provider identification results from the Legal Notice (Impressum) pursuant to § 5 DDG.

18. Consumer dispute resolution

The provider is neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board.

19. Applicable law and final provisions

The law of the Federal Republic of Germany applies. If you are a consumer, this choice of law applies only to the extent that it does not deprive you of the protection of the mandatory consumer-protection provisions of the state of your habitual residence (Art. 6 Rome I Regulation). Should individual provisions of these GTC be invalid, the legal consequence is governed by the statutory provisions (§ 306 BGB).

Annex 1 — Withdrawal instructions

Right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of conclusion of the contract.

To exercise your right of withdrawal, you must inform us (AKK-IT, owner Alexander Kick, Johannes-R.-Becher-Str. 14, 39218 Schönebeck, docsentry@outlook.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but it is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal. If you withdraw from this contract, we must repay all payments received from you without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. The processing is carried out via Google Play as the payment processor.

Early expiry. Your right of withdrawal expires early if you have expressly agreed that we begin performing the contract before the end of the withdrawal period, and you have confirmed your knowledge that, by giving your consent, you lose your right of withdrawal upon the start of performance of the contract (§ 356(5) BGB).
